Terms and Conditions

AVAILABILITY
Equipment should be reserved as far in advance as possible to insure availability. Equipment is subject to prior rental unless reserved for specific dates. Reserved equipment will be charged to customer, used or not, unless reservation is canceled 24 hours prior to beginning of agreed dates of rental. Rentals are for agreed dates only. Extension of rental period must be authorized by Lighting & Production Equipment, Inc., (hereafter referred to as LPE). Unauthorized extension, will be charged at full daily rate. When rental equipment is not available from LPE, customer agrees to accept comparable equipment obtained by LPE from other sources. Rental charges for such equipment can be at rates other than published LPE rates and may be subject to handling charges.

CREDIT
Credit accounts will be granted only upon approval of credit application. Net amount due within 15 days after purchase or agreed date for return of equipment. 1 1/2% per month (18% per annum) will be charged on accounts unpaid over 30 days from date of invoice. All credit accounts unpaid over 30 days shall automatically become COD accounts. LPE can require deposit for up to full value of rented equipment.

TERMS
All sales are F.O.B. manufacturer, unless otherwise expressly stipulated, and all shipping charges are for the account of the buyer. Seller’s responsibility ceases upon delivery of shipment to carrier. Buyers must immediately notify the carrier in writing of any loss or damage to goods in transit.

No delay or forbearance of LPE of any remedy or right constitutes a waiver. The exercise or partial exercise of a remedy or right shall not preclude the further exercise of any remaining remedy. Customer agrees to pay all expenses in any attempt to collect any amount due, including reasonable attorney’s fees, and the retaking, shipping, and storing of any articles specified in any agreements, given as collateral, security or otherwise.

Bulbs, if burned out, must be returned for credit. Broken or nonreturned bulbs will be charged at list price.

Generators must be properly grounded and operated in accordance with current National Electrical Code.

LPE reserves the right to prior approval or designation of qualified driver/operators. Generator and/or vehicle rental price includes the use of generator and/or vehicle only and does not include normal maintenance, fuel, oil, mileage, personnel, shipping, transportation or insurance.

Generator and/or vehicle must be returned with all fuel tanks full. A fueling charge, In addition to fuel costs, will be billed for fueling by LPE. Lessee affirms that he is over the age of 21 years or is a corporation legally authorized to do business in the state of Georgia.

The construction and performance of this agreement shall be determined by the law of the State of Georgia. This instrument constitutes the entire agreement between the seller and buyer; and shall not be amended, altered, or changed except by a written agreement signed by the parties hereto.

DAMAGE
Customer accepts responsibility for all damage, loss, or theft of equipment. Lost or damaged equipment, cleanup, repair, or parts will be charged to customer at current list price plus shipping. Acceptance of return ordered equipment does not waive claims against renter for latent or hidden damage to equipment. Renter further agrees to pay LPE rental at regular rates for such period of time until lost or damaged equipment. shall be replaced.

Customer agrees not to remove or cover the name plate or any identification showing ownership by LPE.

INSTRUCTIONS
Manufacturer’s instructions will be provided when available on request. Proper care, operation, application and understanding of equipment is solely the responsibility of the customer.

INSURANCE/RESPONSIBILITY
Customer is responsible for insurance coverage of equipment equal to the replacement cost at the suppliers list price. Customer assumes all liability in usage of equipment. Such coverage to include loss of any type or nature including but not limited to loss occasioned by deficiency in usage, application or processing. A memorandum of such insurance covering LPE shall be delivered to the office of LPE prior to agreed rental dates. For an additional charge LPE can provide insurance against theft and/or damage (subject to limitations of the policy including any deductible amount). This policy only covers equipment while within the continental limits of the United States. Negligence, willful misconduct or damage and/or loss while in the hands of common carriers is not covered. Proof of acceptable insurance coverage must be delivered to LPE prior to commencement of any rental.

RATES
DAILY RATE: The minimum rental charge is one day. Equipment returned after 10:00 A.M. of day following specified rental dates is considered rented for one additional day.

WEEKLY RATE: Four times the daily rate for equipment retained by customer for a maximum consecutive seven day period.

RENTAL PRICES WILL NOT BE APPLIED TO PURCHASE. ALL APPLICABLE TAXES WILL BE ADDED TO RENTAL CHARGED. PRICES SUBJECT TO CHANGE WITHOUT NOTICE.

SPECIAL OPENING
A charge will be billed for transactions requiring special shop openings, or an extension of normal business hours.

SHIPPING
Customer pays all shipping costs. Equipment will be shipped collect, and must be returned prepaid. Any shipping charges paid by LPE will be billed to the customer plus 25% of shipping charges with a minimum additional charge of $10.00. A charge will be billed for picking up or delivery of shipments to trucking depots, bus stations, etc.. LPE is not responsible for shipping delays. In the absence of specified customer choice, LPE has choice of carrier and date. Rental continues until returned to LPE at their offices.

OUT OF STATE/COUNTRY
Equipment must not be taken out of the state of Georgia or continental limits of the United States, without prior written permission from LPE.

WARRANTY
No warranty of performance is made for equipment beyond its being in working order when it leaves LPE. The equipment is offered for inspection and test at the time of rental. LPE is not responsible for any loss resulting from the use of its equipment or other supplies.

Product not manufactured by seller are warranted and guaranteed only to extent and in the manner warranted and guaranteed to seller by the manufacturer of said products and then only to the extent that they are able to enforce such warranty or guaranty.

PLEASE CHECK YOUR ORDER CAREFULLY BEFORE SIGNING ANY RENTAL AGREEMENT. YOU ARE RESPONSIBLE FOR THE QUANTITY AND CONDITION OF THE EQUIPMENT AND SUPPLIES AS LISTED ON YOUR RENTAL AGREEMENT.
